Friend of Court Briefs

Lockheed Litigation - brief filed for the Council for Education and Research on Toxics in the California Supreme Court, explaining why the court should not adopt a restrictive rule for the admissibility of expert medical and scientific testimony in toxic tort cases.

Parker v. Mobil Oil Corp. - brief filed for the Council for Education and Research on Toxics and esteemed physicians and scientists in the New York Court of Appeal, explaining why the Court should not require a plaintiff in a benzene-leukemia case to precisely quantify his dose of benzene exposure, and explaining that cumulative dose may not be the appropriate metric for assessing benzene exposure. (The Court of Appeal agreed with our clients that a plaintiff need not precisely quantify his benzene dose, specifically noting that intensity of benzene exposure may be more important in the development of leukemia than cumulative benzene dose).

Stephenson v. Dow Chemical Company - brief filed for the Lymphoma Foundation of America and esteemed physicians and scientists in the United States Supreme Court to explain the scientific and medical basis for claims that Agent Orange has caused Vietnam Veterans to develop hematologic malignancies, including Hodgkin's Disease, Non-Hodgkin's Lymphoma, Multiple Myeloma, and Chronic Lymphocytic Leukemia. (The Vietnam Veterans won this case in the United States Supreme Court).
